Can you use an attorney/lawyer instead of an adoption agency?

Is It possible to just use an attorney and avoid the whole adoption agency thing? We adopted our first daughter through an agency and it was terrible and the financial piece was outrageous with what we had to deal with. We just got a possible lead on another adoptive situation but was wondering if we could just use an attorney or a lawyer instead? I am from northwest Wisconsin.  Please share any thoughts ideas or recommendations of what to do.


I don’t believe so. I’m almost positive that Wisconsin is a state that requires agency involvement.
You can check however,  as our adoption was independent and privately arranged, that the fees are reduced when you match yourself because half the work is already done. Our costs were approximately half off what they would’ve been.

SarahLB2 -Who did you go through? I was told that an independent adoption would be less expensive but not by much.

In my state you can, but every state is different, so you will have to look up the law in your own state or call an attorney and ask.

I live in Wisconsin and there are several attorneys that do adoptions.  I am 99% sure you don’t need an agency.

We just went with BCS (Bethany Christian Services) since the birthmother had reached out to them first and it was just easier. But I’m almost positive that while there are attorneys specializing in adoption, it’s for TPR and the whole adoption cannot be by attorney alone.

Just confirmed on another site I belong to that because Wisconsin is such an adoption friendly state (ha!) ... they do require use of attorney and agency.

Agree with SarahLB2 - in WI you do need the agency but should be paying reduced fees. They make it seems as if it is adoption friendly, but in reality it is a money making proposition for the agency.  Sad part is most agencies don’t even offer much in the way of support!!  I believe there is not enough support groups in WI for those that have adopted through an agency whether matched via the agency or independent.  There are groups for those who have adopted via foster care but I really don’t feel that it is the same!  That is just my opinion as an adoptive mother.  Would love to start of join a group like this if there was, so if I am wrong please let me know!!
